How to Enter: Beginning at 9:00 a.m. Eastern Time ("ET") on March 19, 2007 until 5:00 p.m. ET on April 9, 2007 (the "Sweepstakes Period"), you may enter the Scripps Networks, LLC d/b/a FINE LIVING ("Fine Living") 2007 "Wandering Golfer" Sweepstakes (the "Sweepstakes") online by visiting the Fine Living website (www.fineliving.com) (the "Website") and completing and submitting the online entry form (limit one (1) online entry, per valid email address, per eligible person per day). Entries generated by script, macro or other automated means will not be accepted. Incorrect and incomplete entries are void. These Official Rules are also available at the Website or by writing to sending a stamped, self-addressed #10 sized envelope ("SASE") to: Fine Living’s "Wandering Golfer Sweepstakes" Rules, c/o Haley Miranda Group, 8654 Washington Blvd., Culver City, CA 90232. All eligible entries will be entered in the Grand Prize Drawing.
When you enter at the Website, you may be asked to consent to receive promotional e-mails and reminders for upcoming Fine Living promotions and information about Fine Living and the Participating Product Sponsors identified below. Consenting to receive such e-mails is optional and does not have to be agreed to in order to be eligible to enter the Sweepstakes and does not improve your chances of winning. Fine Living ("Main Sponsor"), and all Participating Product Sponsors identified below (collectively with Main Sponsor, the "Sweepstakes Entities"), Haley Miranda Group, and their respective affiliates, subsidiaries, parent corporations, and their advertising and promotion agencies and all local sponsors and prize suppliers, and their respective officers, directors, shareholders, employees and agents, and any and all Internet servers and access provider(s) (collectively, "Released Parties") are not responsible for: any incorrect or inaccurate entry information; human error; technical malfunctions; failures, omission, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, server providers, or software, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participation in this Sweepstakes; inability to access the Website; theft, tampering, destruction, or unauthorized access to, or alteration of entries; entries that are processed late or incorrectly or are incomplete or lost due to computer or electronic malfunction or traffic congestion on the Internet or at any website; or technical, network, computer, printing, typographical or human or other errors or problems relating to or in connection with the Sweepstakes, including, without limitation, errors or problems which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prize or in any Sweepstakes-related materials. Proof of in person submission, or online submission is not considered proof of delivery or receipt. All entries become the property of Main Sponsor and will not be returned. A purchase will not increase chance of winning. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, MAIN SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
Eligibility: This Sweepstakes is open only to legal residents of the fifty (50) United States and the District of Columbia (except CA and HI) who are 21 years of age or older on or before March 19, 2007, except employees and members of their households, whether or not related, and immediate families (spouses, parents, siblings, children and each of their respective spouses, regardless of where they reside) of Main Sponsor, General Motors Corporation, Anheuser-Busch, Inc., and all other participating product sponsors (collectively, the "Participating Product Sponsors"), Haley Miranda Group, and their respective parent companies, subsidiaries, and affiliates, and their advertising and promotion agencies and all local sponsors are not eligible to enter or win a prize. Main Sponsor reserves the right to conduct a background check on potential Grand Prize Winner (as defined below) and reserves the right in its sole discretion to disqualify him/her based on such background check if Main Sponsor determines in its sole discretion that awarding the prize to such potential Grand Prize Winner might reflect negatively on Main Sponsor or any of the Participating Product Sponsors. This Sweepstakes is governed by U.S. law and is subject to all federal, state and local laws and regulations. Void in Puerto Rico, outside the 50 U.S. and D.C. and where prohibited by law.
Grand Prize Drawing: The potential Grand Prize winner ("Grand Prize Winner") will be selected in a random drawing from among all eligible entries received during the entire Sweepstakes Period on or about April 16, 2007 by Haley Miranda Group an independent judging organization ("Sweepstakes Administrator") and will be contacted by phone and/or overnight delivery service on or about April 16, 2007. The odds of winning the Grand Prize depends upon on the number of eligible entries received for the entire Sweepstakes Period.
General Conditions: By entering, all participants and/or entrants agree to be bound by these Official Rules and the decisions of the Main Sponsor and Sweepstakes Administrator, which shall be final and binding and waive any right to claim ambiguity in the Sweepstakes or these Official Rules. The potential Grand Prize Winner will be required to execute an affidavit of eligibility and release of liability and publicity (where permitted), and return same, properly executed, within three (3) days of date of issuance of prize notification. Travel companion of potential Grand Prize Winner must be at least twenty-one (21) years of age or older, unless accompanied by his/her parent or legal guardian, and also must sign and return a Liability and Publicity Release within same time period. If Main Sponsor is unable to contact potential winner within two (2) days of date of the initial attempt to contact, if potential winner and/or travel companion fails to complete and return all requested forms by the specified date, if potential winner is found to be ineligible, or if he/she does not comply with the Official Rules, or if potential winner fails to comply with any of the requirements set forth herein, prize will be forfeited and, at Main Sponsor’s discretion, an alternate prize winner may be selected. If prize notification is returned as undeliverable, this will result in disqualification and, at Main Sponsor’s discretion, an alternate winner will be selected. All applicable federal, state or other tax liabilities (including income taxes) arising from prize acceptance and use in this Sweepstakes not specified in the prize description as being awarded will be the sole responsibility of the Grand Prize Winner. By entering into the Sweepstakes, all entrants consent to the use of their name, photograph likeness, biography, voice and/or video for advertising and promotional purposes, including online announcements, worldwide and without limitation and without additional compensation, notification or permission, except where prohibited by law.
Limitations of Liability: Entry materials that have been tampered with or altered are void. If, in the Main Sponsor’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Sweepstakes, or if computer virus, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Sweepstakes, the Main Sponsor reserves the right at its sole discretion to disqualify any individual who tampers with the entry process and void any entries submitted fraudulently, to modify or suspend the Sweepstakes, or to terminate the Sweepstakes and, if terminated, conduct a random drawing to award the prize using all eligible, non-suspect entries received as of the termination date. Should the Sweepstakes be terminated prior to the stated expiration date, notice will be posted on the Website. In the event of a dispute as to the identity of the winner based on an e-mail address, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry provided he/she is in compliance with the eligibility requirements set forth herein. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
Entrants agree to release, discharge, indemnify and hold harmless the Released Parties from and against any claims, damages or liability due to any injuries, damages or losses to any person (including personal injury or death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize (including any travel or activity related thereto) or participation in any Sweepstakes-related activity or participation in this Sweepstakes, or any claims based on rights of publicity and/or rights of privacy.
Prize: One (1) Grand Prize: The Grand Prize consists of the following: (i) Ten Thousand Dollars ($10,000.00) cash (awarded as a check); and (ii) a trip to Kingsmill Resort in Williamsburg, VA for Grand Prize Winner and one (1) guest which includes the following: (a) round trip coach class air transportation for two (2) people between the major U.S. commercial airport nearest Grand Prize Winner’s residence and Williamsburg, VA; (b) ground transportation between the airport and hotel (the "Hotel"); (c) standard Hotel accommodations in one (1) double occupancy room for five (5) days/four (4) nights (room rate and tax only); (d) two (2) one-day VIP tickets to the 2007 Michelob ULTRA® Open at Kingsmill; (e) one (1) round of golf for winner only to play in the Official Michelob ULTRA Open Pro-Am; (f) one (1) Kingsmill Combination spa treatment package for winner or guest (from a list provided by Sponsor); and (g) two (2) one-day VIP tickets to Busch Gardens®. The total ARV of the Grand Prize: $17,070.00.
If Grand Prize Winner resides within a 100-mile radius of Williamsburg, VA, ground transportation may be provided in lieu air transportation and no compensation or substitution will be provided for difference in prize value. All costs and expenses associated with prize acceptance and use not specifically identified as included in the Grand Prize are the sole responsibility of the Grand Prize Winner, including, but not limited to, meals, incidentals, tips/gratuities, telephone calls, or any other personal expenses incurred during the trip. Grand Prize Winner and guest must travel together the same itinerary and must travel between 5/7/07 – 5/11/07 or on the dates and/or times specified by Main Sponsor or prize will be forfeited and, at Main Sponsor’s discretion, awarded to an alternate winner and Sponsor will have no further obligation to previous Grand Prize Winner. All travel arrangements must be made through Main Sponsor’s agent, on a carrier of Main Sponsor’s choice. Grand Prize Winner and guest are responsible for obtaining all required travel documents. All prize elements will be awarded directly to the Grand Prize Winner. No payments will be made to third parties. Some travel restrictions may apply. Tickets are subject to terms and conditions specified by issuers. Grand Prize Winner and guest must agree to comply with all golf course and theme park rules and regulations. Failure to do so, as determined by Sponsor in its sole discretion, may result in forfeiture of such portion of prize. No transfer, substitution, or cash equivalent for prize allowed except at Main Sponsor’s sole discretion. Main Sponsor reserves the right, at its sole discretion, to substitute prize (or portion thereof) of comparable or greater value. Prize is awarded "as is" with no warranty or guarantee, either express or implied by Main Sponsor. All prize details are at Main Sponsor’s sole discretion.
Winner’s Name: Beginning on or about April 30, 2007, you may obtain the name of the Grand Prize Winner, either by going to the Website or mailing a SASE (VT residents may omit postage) to: Fine Living’s "Wandering Golfer" Sweepstakes - Winner’s Name, c/o Haley Miranda Group, 8654 Washington Blvd., Culver City, CA 90232. Requests received after May 31, 2007 will not be honored.
