The following promotion is intended for viewing in the United States only (including its territories, possessions, and commonwealths, except Puerto Rico) and will be construed and evaluated according to United States laws. Do not proceed in this site if you are not a legal U.S. resident, 21 years or older, and accessing this site in the United States, its territories, possessions, or commonwealths (except Puerto Rico).
FINE LIVING’S "IT’S HOT INSIDE" SWEEPSTAKES – 2008 OFFICIAL RULES – NO PURCHASE OR ONLINE ENTRY NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. VOID IN PUERTO RICO AND WHERE PROHIBITED.
How to Enter: Beginning at 9:00 a.m. Eastern Time ("ET") on July 7, 2008 until 5:00 p.m. ET on August 4, 2008 (the "Sweepstakes Period"), you may enter the 2008 Fine Living Network ("Fine Living") "It’s Hot Inside" sweepstakes (the "Sweepstakes") in any of the following ways: (i) online by visiting the Fine Living website (www.fineliving.com) (the "Website") and completing the online entry form (limit one (1) online entry, per valid email address, per eligible person per day); or (ii) by mail by hand printing your name, complete address, phone number and date of birth either on a postcard or on a separate piece of paper no larger than 8½ x 11 inches, and mailing the postcard or paper in an envelope with proper postage affixed to: "Fine Living’s It’s Hot Inside Sweepstakes", P.O. Box 1505, Culver City, CA 90232. Entrants using US mail may enter as often as they wish. Mail-in entries must be postmarked by August 4, 2008, and received by August 11, 2008. Limit one (1) entry per stamped outer envelope. Mechanically reproduced or hand-stamped entries or mailing labels or entries generated by script, macro or other automated means will not be accepted. Incorrect, illegible, and incomplete entries are void. When you enter at the Website, you may be asked to consent to receive promotional e-mails and reminders for upcoming Fine Living promotions and information about Fine Living and the Participating Product Sponsors identified below. Consenting to receive such e-mails is optional and does not have to be agreed to in order to be eligible to enter the Sweepstakes and does not improve your chances of winning. Scripps Networks, LLC d/b/a Fine Living ("Main Sponsor"), and all Participating Product Sponsors identified below (collectively with Main Sponsor, the "Sweepstakes Entities"), and their respective affiliates, subsidiaries, parent corporations, partners, prize suppliers and all of their respective officers, directors, shareholders, employees and agents, and any and all Internet servers and access provider(s) (collectively with Sweepstakes Entities, "Released Parties") are not responsible for: any incorrect or inaccurate entry information; human error; technical malfunctions; failures, omission, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, server providers, or software, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participation in this Sweepstakes; inability to access the Website; theft, tampering, destruction, or unauthorized access to, or alteration of entries; transactions that are processed late or incorrectly or are incomplete or lost due to computer or electronic malfunction or traffic congestion on the Internet or at any website; or for technical, network, computer, typographical, printing or human or other errors relating or in connection with the Sweepstakes, including, without limitation, errors which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prizes or in any Sweepstakes-related materials; and any entries which are late, lost, incomplete, inaccurate, delayed, misdirected, stolen, mutilated, illegible or postage due, or any combination thereof. Proof of mailing, in person submission, or online submission is not considered proof of delivery or receipt. All entries become the property of Main Sponsor and will not be returned. A purchase will not increase chance of winning. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, MAIN SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
Eligibility: This Sweepstakes is open only to legal residents of the U.S. and its territories, possessions and commonwealths (excluding Puerto Rico) who are 21 years of age or older on or before July 7, 2008, except employees and members of their households, whether or not related, and immediate families (spouses, parents, siblings, children and each of their respective spouses, regardless of the where they reside) of Fine Living as the Main Sponsor and General Motors Corporation, SC Johnson & Son, Inc., The Sherwin-Williams Company, Geico, and all other participating product sponsors (collectively, the "Participating Product Sponsors"), Haley Miranda Group, and their respective parent companies, subsidiaries, and affiliates, and their advertising and promotion agencies and all local sponsors are not eligible to enter or win a prize. Entrants who have won a prize in any Fine Living or Scripps Networks, LLC promotion in the 90 days prior to the commencement of the Sweepstakes are ineligible. Main Sponsor reserves the right to conduct a background check on potential winner and reserves the right in its sole discretion to disqualify any person based on such background check if Main Sponsor determines in its sole discretion that awarding the prize to such potential winner might reflect negatively on Main Sponsor or any of the Participating Product Sponsors. By entering, all participants and/or entrants release the Released Parties from and against all claims and damages arising in connection with each entrant’s participation and/or entry in the Sweepstakes and/or their receipt or use of the prize awarded in this Sweepstakes. This Sweepstakes is governed by U.S. law and is subject to all applicable federal, state and local laws and regulations. Void in Puerto Rico, outside the U.S. and where prohibited by law.
Grand Prize Drawing: The potential Grand Prize Winner will be selected in a random drawing from among all eligible entries received during the entire Sweepstakes Period on or about August 18, 2008 by Haley Miranda Group, an independent judging organization ("Sweepstakes Administrator") and will be contacted by phone, email, and/or overnight delivery service on or about August 20, 2008. The odds of winning the Grand Prize depends upon the number of eligible entries received for the entire Sweepstakes Period.
Main Sponsor and Sweepstakes Administrator’s decisions with respect to the Grand Prize Winner and other matters pertaining to the Sweepstakes shall be final and binding. By entering into the Sweepstakes, each entrant consents to the use by Sweepstakes Entities and their respective designees of his/her name, likeness, biography, voice, performance and/or video in any and all media, including online announcements now or hereafter known, worldwide and without limitation and without additional compensation, notification or permission, except where prohibited by law.
General Conditions: Potential Grand Prize Winner will be required to execute an affidavit of eligibility and release of liability and publicity (where permitted), and return same, properly executed, within seven (7) days of date of issuance of prize notification. If Main Sponsor is unable to contact the potential winner within seven (7) days of the initial attempt, if the potential winner fails to execute and return all requested documents by the specified date or if the potential winner fails to comply with any of the requirements or prize notification is returned as undeliverable, prize will be forfeited and, at Main Sponsor’s discretion, an alternate winner shall be selected.
Entry materials that have been tampered with or altered are void. If, in the Main Sponsor’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Sweepstakes, or if computer virus, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Sweepstakes, the Main Sponsor reserves the right at its sole discretion to disqualify any individual who tampers with the entry process and void any entries submitted fraudulently, to modify or suspend the Sweepstakes, or to terminate the Sweepstakes and, at its discretion, conduct a random drawing to award the prize using all eligible, non-suspect entries received as of the termination date. Should the Sweepstakes be terminated prior to the stated expiration date, notice will be posted on the Website. In the event of a dispute as to the identity of the winner based on an e-mail address, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry and such individual must be eligible according to these rules. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
Prize: One (1) Grand Prize Winner will win a Visa gift card in the amount of Twenty-Seven Thousand Dollars ($27,000) intended to be used toward the purchase of the following: (i) decoration and home improvements ($10,000); (ii) one (1) high definition theater system with surround sound ($3,000); (iii) select kitchen appliances ($4,000); and (iv) select home furnishings (ARV: $10,000). Total approximate retail value ("ARV") of Grand Prize: $27,000.
The Grand Prize Winner is advised to obtain the services of a qualified and licensed architect and/or contractor to implement the Grand Prize Winner’s makeover. The Sweepstakes Entities will not be responsible for any architectural design, construction, or other related services required to accomplish the home makeover and will not be a party to any contracts relating to such services. Any and all warranties and guarantees are subject to the respective manufacturer’s terms. Some restrictions may apply. All costs, taxes, fees, and other expenses associated with the acceptance and use of any element of prize not specifically addressed above as being provided are the sole responsibility of the Grand Prize Winner. All federal, state, and local taxes on prize are Grand Prize Winner’s responsibility. The Grand Prize Winner will be issued a 1099 tax form for the ARV of the prize. The specifics of all aforementioned elements of any prizes in the Sweepstakes shall be solely determined by Main Sponsor. Grand Prize cannot be transferred, substituted, or redeemed for cash except at Main Sponsor’s sole discretion. Main Sponsor reserves the right to substitute prize, or portions thereof, with a prize of comparable or greater value. The Grand prize will be awarded.
Winner’s Name: Beginning on or about August 22, 2008 you may obtain the name of the Grand Prize Winner, either by going to the Website or mailing a SASE to: "Fine Living’s It’s Hot Inside Sweepstakes Winner’s Name", c/o Haley Miranda Group, 8654 Washington Blvd., Culver City, CA 90232. Requests received after September 15, 2008 will not be honored.
