  1. How to Enter: Fine Living Networks (Fine Living) Surprise Vacations Give Back Giveaway Contest (the Contest) is a nationwide search to identify three (3) individuals who have made a positive impact on their community. The Contest begins at 9:00 a.m. (Eastern Time [ET]) on July 10, 2009, and ends at 5:00 p.m. (ET) on August 31, 2009 (the Contest Period). Applicants (each, an Entrant) must submit the following content by uploading it on the Fine Living website (www.fineliving.com) (the Website): (i) one (1) photo of the Nominee (as defined below). Photo may only feature Nominee and/or the Nominees charitable endeavor; and (ii) a short description (two hundred fifty (250) character limitation, including spaces and punctuation) describing how the Nominee has made a positive change within his/her community (collectively, with entry form and information, the Submissions). Entrants may enter the Contest by nominating themselves or they may nominate another person (each, a Nominee). If you are not nominating yourself, you should obtain Nominees permission prior to entering a Submission. Main Sponsor (as defined below) is not responsible for the content contained in the Submissions. Entrants must visit the Website and complete the online entry form. Limit one (1) Submission, per valid email address and per eligible person per Nominee. Submissions received from any person or email address in excess of the stated limitation will be void. If any Nominee is nominated more than once, only the first Submission for such Nominee will be considered. All online entries must be received by 5:00 p.m. ET on August 31, 2009 to be considered. Completed Submissions may be posted on Pickle.com. Main Sponsor is not obligated to post completed Submission, and may reject any Submissions as it determines in its sole discretion. All late, illegible and incomplete Submissions will be void. Each Submission must also include the Entrant and Nominees full name, address, phone number (including area code), and e-mail address. Scripps Networks, LLC d/b/a Fine Living Network (Main Sponsor) will not verify receipt of Submissions. All Submissions become the sole property of Main Sponsor and will not be returned. Any attempt by any Entrant to obtain more than the stated number of Submissions by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that Entrants Submission and that Entrant may be disqualified. Submissions generated by script, macro and other automated means and Submissions by any means which subvert the entry process will be void.

    Submission Guidelines:

    Submissions may not contain, as determined by the Main Sponsor, in its sole discretion, any content that: is sexually explicit or suggestive; unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group; profane or pornographic; contains nudity; promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing); promotes any activities that may appear unsafe or dangerous; promotes any particular political agenda or message; is obscene or offensive; endorses any form of hate or hate group; appears to duplicate any other submitted Submissions; defames, misrepresents or contains disparaging remarks about other people or companies; contains trademarks, logos, or trade dress owned by others, without permission; contains any personal identification, such as license plate numbers, personal names, e-mail addresses or street addresses; contains copyrighted materials owned by others (including photographs, sculptures, paintings, and other works of art or images published on or in websites, television, movies or other media); contains materials embodying the names, likenesses, or other indicia identifying any person, other than the Nominee; contains look-alikes of celebrities or other public or private figures, living or dead; communicates messages or images inconsistent with the positive images and/or good will to which Main Sponsor wishes to associate; and/or violates any law.

    Submission must be the original work of the Entrant, must be in English, may not have been previously published, may not have won previous awards, and must not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity. If the Entrant did not nominate him or herself, the Entrant is responsible for obtaining, prior to entering the Submission, any and all releases and consents necessary to permit the use and exhibition of the Submission by Main Sponsor in the manner set forth in these Official Rules, including, without limitation, name and likeness permissions from the Nominee. Main Sponsor reserves the right to request proof of this permission in a form acceptable to Main Sponsor from any entrant at any time. Failure to provide such proof may, if requested, render Submission null and void. By submitting a Submission, Entrant warrants and represents that he/she the Nominee appearing in the Submission (if not same) consents to the submission and use of the Submission in the Contest and to its use as otherwise set forth herein.

  2. Eligibility: Entrants must be legal residents of the fifty (50) United States or the District of Columbia, and be 18 years of age or older as of July 10, 2009 to be eligible to enter. Nominees must be legal residents of the fifty (50) United States or the District of Columbia, and be 18 years of age or older as of July 10, 2009, to be eligible to be nominated. Entrants and Nominees (if not same) who have won a prize in any Scripps Networks, LLC promotion in the ninety (90) days prior to the commencement of the Contest are ineligible. Contest is void in Puerto Rico and where restricted or prohibited by law. The Contest, and any website pages and advertisements relating thereto, is intended for viewing only within the 50 United States and the District of Columbia. The Contest is not open to employees, or members of their households, whether or not related, and/or immediate families (spouses, parents, siblings, children and each of their respective spouses, regardless of where they reside), of Scripps Networks, LLC, Envision Promotions, LLC, participating affiliates, participating retailers, promotional partners, and each of their respective parent companies, subsidiaries, and affiliates, or their advertising and promotion agencies (collectively, the Contest Entities). The Contest is governed by U.S. law and is subject to all federal, state and local laws and regulations.

  3. Privacy: When you enter at the Website, you may be asked to consent to receive promotional e-mails and reminders for upcoming Fine Living promotions and information about Fine Living. Consenting to receive such e-mails is optional and does not have to be agreed to in order to be eligible to enter the Contest and does not improve your chances of winning. In the event you do consent to receive these e-mails, the use of such e-mails shall be subject to the privacy policy of Scripps Networks, LLC, which is available on the Website.

  4. Winner Determination Three (3) potential winners (the Grand Prize Winner, the First Prize Winner, and the Second Prize Winner collectively, the Winners) will be selected based upon the criteria described below on or about September 1, 2009, from among all eligible Submissions received during the Contest Period. The potential Winners will be selected from all eligible Submissions received by an independent judging agency based on the following judging criteria:

    • The overall quality of the Submission (30%)
    • Nominees charitable work in his/her community or charitable activity (having local, national, or global impact) (70 %)

    The Submission with the highest score will be deemed the potential Grand Prize Winner. The Submission with the next highest score will be deemed the potential First Prize Winner. The Submission with the next highest score will be deemed the potential Second Prize Winner. In the event of a tie, an additional, tie-breaking judge will determine the Winner(s) based on the criteria listed herein. Sponsor reserves the right not to award all prizes if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Entries. Prize awards are subject to verification of eligibility and compliance with these Official Rules. Eligible Submissions may be posted on the Website or Pickle.com; however, in no way shall such promotion influence the final selection of the potential Winners. By submitting a Submission, Entrant (and Nominee, if not same) hereby grants permission for the Submission to be posted on the Website and/or Pickle.com. Entrant (and Nominee, if not same) agrees that Released Parties (as defined below) are not responsible for any unauthorized use of Entries by third parties. Released Parties not guarantee the posting of any Submissions.

    Winner Notification: The potential Winners and Entrants (if not same) will be notified by telephone, email, and/or overnight mail delivery on or about September 4, 2009, or on such other date as determined by Main Sponsor. Main Sponsors and judges decisions with respect to the potential Winners, and other matters pertaining to the Contest shall be final and binding. The potential Winners and Entrants (if not same) will each be required to execute an Affidavit of Eligibility, a Liability Release, and a Publicity Release (Affidavit/Release), to be signed and returned within seven (7) days of notification date. If Main Sponsor is unable to contact a potential Winner and/or Entrant (in the case where the Entrant is not the Nominee), if a potential Winner and/or Entrant is found to be ineligible, if a potential Winner and/or Entrant fails to complete and return all forms by the specified date, if potential Winner and/or Entrant fails to comply with any of the requirements, if any Winner notification is returned as undeliverable, or any potential Winner and/or Entrant is not in compliance with these Official Rules, Main Sponsor reserves the right to notify a runner-up, at its sole discretion. If any potential Winner is an eligible minor in his/her jurisdiction of residence, Sponsor reserves the right to award the prize in the name of his/her parent or legal guardian who will be responsible for fulfilling all requirements imposed on Winners set forth herein (and, if Grand Prize Winner, must accompany such Grand Prize Winner on trip as his/her travel companion.

  5. Prizes: NOTE: Prizes will be awarded to the Nominees as opposed to the Entrants (if not same person). (A) Grand Prize (1): One (1) Grand Prize Winner will win the following: (i) air transportation for Grand Prize Winner and one (1) travel companion from a major U.S. gateway airport nearest Grand Prize Winners residence to Waikiki, Hawaii (Approximate Retail Value (ARV): $1,400); (ii) hotel accommodations consisting of one (1) double occupancy room for eight (8) days/seven (7) nights (room rate and tax only at the Hilton Hawaiian Village in Waikiki or similar hotel) (ARV: $1,600); and (iii) attendance to a luau. (ARV of the Grand Prize: $3,000). (B) First Prize (1): The First Prize Winner will receive one (1) gift certificate with a value of one thousand dollars ($1,000) for use at Zappos.com. Gift certificate is subject to certain terms and conditions specified by Zappos.com. (C) Second Prize (1): The Second Prize Winner will receive two (2) pieces of luggage (selected by Main Sponsor) provided by Hartmann Luggage (ARV: $1,045). Total ARV of all prizes in this Contest: $5,045. Grand Prize Conditions: Actual value of Grand Prize may vary based on dates of travel and point of departure. If Grand Prize Winner resides within a reasonable distance from destination, Main Sponsor reserves the right to substitute air transportation with ground transportation and no compensation or substitution will be provided for the difference in prize value. Any difference between stated value and actual value will not be awarded. Travel companion of potential Grand Prize Winner must be at least twenty-one (21) years of age or older, child or legal ward of Grand Prize Winner, and must sign a Liability and Publicity Release. If travel companion is the child or legal ward of Grand Prize winner, Grand Prize Winner will be required to execute and return all required documents on behalf of such child or legal ward All travel must be completed by July 1, 2010, and must be arranged with Main Sponsor a minimum of sixty (60) days in advance, and is subject to availability and Main Sponsors approval. If Grand Prize Winner is unable to fulfill Grand Prize during the specified time period, Grand Prize Winner forfeits the Grand Prize, and, at Main Sponsors sole discretion, a runner-up may be notified. All travel dates will be subject to approval by the Main Sponsor, and once made may not be altered except by Main Sponsor. Some restrictions and blackout dates may apply. The hotel accommodations do not include meals, incidentals, tips, telephone calls, or any other personal expenses incurred during the trip. Winner and travel companion are responsible for obtaining all required travel documents prior to travel. Winner and travel companion must travel together on the same itinerary. Winner and travel companion agree to comply with all venue rules and regulations. Failure to do so may result in forfeiture of such portion of prize. All federal, state and local taxes and any other expenses not specifically identified as being included as part of the Grand Prize are the sole responsibility of the Grand Prize Winner, including, without limitation, ground transportation, luggage fees, meals, souvenirs and gratuities.

  6. General Prize Conditions: The prizes cannot be transferred, substituted or redeemed for cash (if non-cash portion of prize) except at Main Sponsors sole discretion, which reserves the right to substitute any prize, or portion(s) thereof, with a prize of comparable or greater value in its sole discretion. All prizes will be awarded. All federal, state, and local taxes (including income taxes) and any other costs and expenses associated with prize acceptance and use not specified herein as being provided are the respective Winners responsibility. Prizes are awarded as is with no warranty or guarantee, either express or implied by Main Sponsor. All prize details are at Main Sponsors sole discretion. The specifics of all aforementioned elements appearing on the Website and concerning the prizing in the Contest shall be solely determined by the Contest Entities. If an Entrant does not agree with all of the foregoing elements associated with being a potential Winner, the respective prize will be forfeited and, at Main Sponsors sole discretion, a runner-up may be notified.

    As outlined in the Terms of Use on the Website, except where prohibited by law, acceptance of the position as a potential Winner constitutes permission for the Contest Entities to use said potential Winners (and Entrants, if not same) name, photograph, likeness, statements, biographical information, voice, and city and state address on a worldwide basis, and in all forms of media now known or hereafter devised, in perpetuity, without further compensation, notification or permission.

  7. Contest Conditions: All Submissions become the property of the Contest Entities, and will not be returned, and may be deemed a promotional tool of the Contest Entities under US copyright law. By entering a Submission, Entrant (and Nominee, if not same) further agrees that the Contest Entities shall be the exclusive owners of the Submission (including all rights embodied therein and all copyrights and trademarks associated with any images or descriptions), and the Contest Entities and their assigned agent(s), will have the right to reproduce, exploit, publish, adapt, modify, edit and/or revise the written Submissions, including, without limitation, the names and likenesses of any persons or locations embodied therein or any part of the Entrants Submission, in their sole discretion, in any and all media now known or hereafter devised, throughout the world, in perpetuity, without compensation, notification or permission to Entrant or Nominee (if not same). Entries are deemed void if submitted outside authorized channels. By participating, Entrants (and Nominees, if not same) agree to be bound by these Official Rules and the decisions of the Main Sponsor and Contest Entities, which shall be final and binding, and waive any right to claim ambiguity in the Contest or these Official Rules. Nominees and Entrants also agree to release, discharge, indemnify and hold harmless the Contest Entities and each of their respective officers, directors, employees, representatives and agents (collectively, the Released Parties) from and against any claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize (including any travel/activity related thereto) or participation in this Contest. This Contest is subject to all applicable federal, state and local laws and regulations. Contest is void where prohibited and/or restricted by law.

    The sponsor of this promotion is Scripps Networks, LLC d/b/a Fine Living, which is solely responsible for all aspects of the promotion. By participating in this promotion, all participants and prize winners agree that Hilton Hotels Corporation, their partnerships, subsidiaries and affiliates and each of such entities respective officers, directors, agents and employees are not responsible or liable for any injury, loss, illness, litigation or damage that may occur from participation in the promotion or acceptance, possession, use or misuse of prizes. In the event that any dispute arises regarding the meaning or interpretation of these official rules, participants agree that the dispute shall be resolved by applying the laws of the State of New York and that it shall be resolved by and within the courts of that State. Limitations of Liability: The Released Parties are not responsible for: any incorrect or inaccurate entry information; human error; technical malfunctions of any kind; failures, omission, interruption, deletion, or defect of any telephone network, computer, satellite, cable, Internet Service Provider (ISP), online systems, computer equipment, server providers, or hardware or software, including any injury or damage to participants or any other persons computer relating to or resulting from participation in this Contest; or for inability to access the Website; theft, tampering, destruction, or unauthorized access to, or alteration of Submissions; printing, typographical, mechanical, electronic, network or human or other errors; or any other errors or problems that may occur in connection with the Contest, including, without limitation, errors or problems that may occur in the administration of the Contest, the processing of Submissions, the announcement of the prizes, the incorrect uploading of the photo or in any other Contest-related materials. Released Parties are also not responsible for any Submissions which are late, lost, incomplete, inaccurate, scrambled, delayed, damaged, misdirected, stolen, mutilated or undelivered, or any combination thereof. Main Sponsor may prohibit an Entrant from participating in the Contest or winning a prize if, in its sole discretion, it determines that said Entrant(or Nominee, if not same) is attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or any other unfair playing practices or intending to annoy, abuse, threaten or harass any other Entrants or Main Sponsors representatives.
