How to Enter: Beginning at 9:00 a.m. Eastern Time ("ET") on June 18, 2007 until 5:00 p.m. ET on July 16, 2007, you may enter the Scripps Networks "Summer to the Max" sweepstakes (the "Sweepstakes") in any of the following ways: (i) online by visiting the Home & Garden Television ("HGTV") website (www.hgtv.com), the DIY- Do It Yourself Network ("DIY") Network website (www.DIYNetwork.com), the Fine Living ("Fine Living") website (www.FineLiving.com), the Great American Country ("GAC") website (www.gactv.com), or the Food Network ("Food Network") website (www.foodnetwork.com) (collectively, the "Websites," and each, a "Website") and completing the online entry form (limit one (1) online entry per valid email address, per eligible person per day); or (ii) hand printing your name, complete address and phone number either on a postcard or on a separate piece of paper no larger than 8_ x 11 inches, and mailing the postcard or paper to: "Summer to the Max Sweepstakes," P.O. Box 51622, Knoxville, TN 37950. Online entrants may receive up to five (5) additional entries per day if they use the "refer a friend" option as follows: (i) visit one (1) of the Websites; (ii) fill out the online form and provide the requested information as directed for up to five (5) friends per day; and (iii) for each referred friend who visits one (1) of the Websites and enters the Sweepstakes by 11:59 p.m. on the day the referring entrant filled out the online form, the referring entrant will receive one (1) additional entry in the Sweepstakes. Entrants using U.S. mail may enter as often as they wish. Mail-in entries must be postmarked by July 16, 2007 and received by July 23, 2007. Limit one (1) entry per envelope. Mechanically reproduced or hand-stamped entries will not be accepted. Incorrect, illegible, and incomplete entries are void. When you enter at any of the Websites, you may be asked to consent to receive promotional e-mails and reminders for upcoming promotions and/or information about the Networks (as defined below). Consenting to receive such e-mails is optional and does not have to be agreed to in order to be eligible to enter the Sweepstakes and does not improve your chances of winning. In the event you do consent to receive these e-mails, the use of such e-mails shall be subject to the privacy policy of Scripps Networks, LLC, which are available on the Websites. Scripps Networks, LLC and Television Food Network, G.P. (collectively, "Main Sponsor") and Orbitz LLC, S. C. Johnson & Son, Inc., Choice Hotels International(R), Bacardi(R) Mixers, and other participating sponsors (collectively with Main Sponsor, the "Sweepstakes Entities"), Ritway, Inc., and their respective affiliates, subsidiaries, parent corporations, and their respective officers, directors, shareholders, employees and agents, and any and all Internet servers and access provider(s) are not responsible for: any incorrect or inaccurate entry information; human error; technical malfunctions; failures, omission, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, server providers, or software, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this Sweepstakes; inability to access the Websites; theft, tampering, destruction, or unauthorized access to, or alteration of entries; transactions that are processed late or incorrectly or are incomplete or lost due to computer or electronic malfunction or traffic congestion on the Internet or at any web site; printing or human or other errors; and any entries which are late, lost, incomplete, misdirected, stolen, mutilated, illegible or postage due, or any combination thereof. Proof of mailing, in person submission, or online submission is not considered proof of delivery or receipt. All entries become the property of Main Sponsor and will not be returned. Purchase will not increase chance of winning.
How Winner will be Determined: The Grand Prize Winner will be selected in a random drawing from among all eligible entries on approximately July 27, 2007 by Ritway, Inc., an independent judging organization ("Administrator"), and will be contacted either in person or by overnight courier and phone on or about July 31, 2007. Administrator's decisions with respect to Grand Prize Winner and other matters pertaining to the Sweepstakes shall be final. The prospective winner may be required to sign an affidavit of eligibility and release of liability and publicity (where permitted), and return same, properly executed, within 10 days of issuance of prize notification. If Main Sponsor are unable to contact the prospective winner, if the prospective winner fails to complete and return all requested forms by the specified date, or if the prospective winner fails to comply with any of the requirements, his/her prize will be forfeited and an alternate prospective winner shall be selected. By entering into the Sweepstakes, all entrants consent to the use of their name, photograph, likeness, biography, voice and/or video for advertising and promotional purposes, including online announcements, worldwide and without limitation and without additional compensation, except where prohibited by law. The odds of winning depend upon the number of eligible entries received for the applicable drawing.
Entry materials that have been tampered with or altered are void. If, in the Administrator's opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Sweepstakes, or if computer virus, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Sweepstakes, the Administrator reserves the right in its sole discretion to disqualify any individual who tampers with the entry process and void any entries submitted fraudulently, to modify or suspend the Sweepstakes, or to terminate the Sweepstakes and conduct a random drawing to award the prizes using all eligible, non-suspect entries received as of the termination date. Should the Sweepstakes be terminated prior to the stated expiration date, notice will be posted on the Websites. Any attempt by an entrant or any other individual to deliberately damage any Website or undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil laws and should such an attempt be made, Main Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. In the event of a dispute as to the identity of the winner based on an e-mail address, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
Eligibility: This Sweepstakes is open only to legal residents of the U.S. and its territories, possessions and commonwealths (excluding Puerto Rico) who are 18 years of age or older, except employees and members of their households and immediate families (spouses, parents, siblings, children and each of their respective spouses) of the Sweepstakes Entities and their respective parent companies, subsidiaries, and affiliates, and their advertising and promotion agencies and all local sponsors. Online entrants may also receive information from Main Sponsor regarding other promotional offers. By entering, all participants and/or entrants release the Sweepstakes Entities and their respective parent companies, subsidiaries, and affiliates, and their respective agents, advertising and promotion agencies, affiliated companies, sweepstakes partners and prize suppliers, and all of their respective affiliated companies, employees, officers, directors and shareholders, from and against all claims and damages arising in connection with each entrant's participation and/or entry in the Sweepstakes and/or their receipt or use of any prize awarded in this Sweepstakes. Any and all warranties and guarantees are subject to the respective manufacturer's terms. This Sweepstakes is governed by U.S. law and is subject to all federal, state and local laws and regulations. Void in Puerto Rico, outside the U.S. and where prohibited by law.
Grand Prize: One (1) Grand Prize Winner will win One Million Dollars ($1,000,000) in cash which will be paid out in installments of Forty Thousand Dollars ($40,000) per year over twenty-five (25) years through an annuity. Sponsor estimates that the current value of the annuity is approximately $673,717.92 as of May 2, 2007. Present value of the Grand Prize will vary depending on interest rates and market conditions at the time of the award.
All costs, taxes, fees, and expenses associated with any element of any prize not specifically addressed above are the sole responsibility of the Grand Prize Winner. All federal, state and local taxes on prizes are the Grand Prize Winner's responsibility. Winner will be issued a 1099 tax form for the cash value of the Grand Prize. The specifics of all aforementioned elements of the Grand Prize in the Sweepstakes shall be solely determined by Sponsor. Some restrictions may apply. Prize cannot be transferred, substituted or redeemed for cash except at Main Sponsor's sole discretion. Main Sponsor reserves the right to substitute the prize, or portions thereof, with a prize of equal or greater value. The Grand Prize will be awarded.
Winner's List: Beginning on or about August 6, 2007 you may obtain the name of the Winner, either by going to the Website or mailing a SASE to: "Scripps Networks' Summer to the Max"- Winner's List, P.O. Box 51573, Knoxville, TN 37950. Requests received after August 31, 2007 will not be honored.
